Baltimore Driver Injured by MTA Mobility Sedan Wins $100K

MARYLAND - A Baltimore City Circuit Court jury has awarded more than $100,000 to a woman injured in a car accident involving a sedan under contract with the Maryland Transit Administration.

Leslie W. Roberts' verdict against the sedan's owner, MV Transportation Inc., included $75,000 in non-economic damages, as well as $16,000 in medical expenses. The May 2006 accident damaged Roberts' right shoulder, leading to surgery and 27 physical therapy sessions before Roberts stopped because the sessions were not helping, according to her lawyer.

"She wanted to get on with her life," said Rhonda I. Framm, an Owings Mills solo practitioner. "It was painful when it happened and painful when she left. "

MV Transportation is one of two contractors that provide the MTA's mobility paratransit/vehicles for citizens unable to use the bus, light rail or subway. Roberts was driving westbound on Gwynns Falls Road while Lucinda Beverly was driving the sedan eastbound, according to the complaint filed in March 2008.

Beverly failed to yield the right-of-way to Roberts as Beverly attempted to make a left-hand turn onto Garrison Boulevard, the complaint states.

Roberts was taken to Mercy Medical Center and underwent arthroscopic shoulder surgery, according to the complaint. She continued her supervisor job at the Rosewood Center in Owings Mills despite having the use of only one arm, particularly problematic because of the occasionally physical nature of working with developmentally disabled adults, Framm said. Roberts' testimony about her determination resonated with the jury during the weeklong trial before Judge Lynn K. Stewart, Framm said.
